
Are You Complying with the New CAN-SPAM Provisions?
The FTC has recently approved four new rule provisions under the CAN-SPAM Act that could affect your marketing efforts for the remainder of 2008. These provisions are intended to clarify the Act's requirements and address the four following topics:
- New opt-out requirements
- Modifications to the definition of "sender"
- Changes to the definition of a "valid physical postal address" to include an accurately-registered post office box or private mailbox
- A definition of the term "person" was added to clarify that CAN-SPAM obligations are not limited to natural persons

New FTC COPPA Rules Affecting Your Web site and Email Marketing
In December 2007, the FTC updated Children's Online Privacy Protection Rule FAQs 27, 30, and 44 - all clarifying compliance regarding one-time email exceptions. The FAQs now specify three key practices to consider when designing a forward-to-a-friend feature for a children's Web site.
Most notable of these changes were made to FAQ 44 which identifies how Web sites can use the one-time email exception for a forward-to-a-friend feature. The exception may be employed when certain criteria are met.

Tip: Prevent Unnecessary Watchdog Escalation
When providing your new Watchdog point of contact’s email address to TRUSTe, it may be helpful to create a separate email address and/or a separate inbox in order to keep track of your Watchdog complaints. This could be as simple as creating an alias such as: trustewd@[yourdomain].com. You will find this to be an efficient way in which your company tracks and delegates new and open Watchdogs. Additionally, a supplementary inbox will reduce the risk of Watchdogs going unread or unnecessarily escalating if your point of contact is inaccessible.
Furthermore, to ensure you receive all correspondence from our Compliance Team, add the compliance@truste.org address to your whitelist of permitted senders.
