Provisionally certified companies are required to take additional steps in order to obtain full certification, including:

1. Update or upgrade software programs of legacy users, where possible.
2. Immediately undergo a higher degree of compliance monitoring of its software under the program.
3. Immediately separate any advertising inventory that is displayed to its users into two distinct sets: Certified Ad Inventory and Non-Certified Ad Inventory.
4. Complete additional requirements to satisfy notice and choice obligations for legacy users of their software.

Certified Standard Software: means software that neither serves advertising outside of its own interface (e.g. as pop-ups), nor collects a user's behavior in another application to transfer to a third party.

Certified Advertising Software: means software that displays advertisements such that the display of any advertisement is not directly triggered by the User's interaction with the Certified Software, unless such ads are displayed within the context of the application and the use of any other application is not disrupted. Covered Advertising Software is often bundled with other software, such as screensavers, games, weather applications, and other popular User software. Covered Advertising Software may include Covered Tracking Software where the Covered Advertising Software also meets the definition of Covered Tracking Software.

Certified Tracking Software: means any software that collects a User's web browsing or other information entered into a separate application, where a purpose is to transfer such information to a destination off the User?s computer that is not controlled by the User. Covered Tracking Software does not include software where the collection and transfer purposes are network integrity or functionality, application integrity, or information security. (Covered Tracking Software may include Covered Advertising Software where the Covered Tracking Software also meets the definition of Covered Advertising Software.)
